Terms & Conditions for Giver

1. Introduction

Welcome to Giver – Digital Church Contributions Made Easy (Hereinafter referred to as “Giver”, “we”, “our”, “us”).

These Terms & Conditions (Hereinafter referred to as “The terms”) govern your use of the Giver mobile application, website, and related services ( Hereinafter referred to as “Services”).

By downloading, accessing, or using Giver, you agree to comply with and be bound by these Terms.

If you do not agree, please discontinue using the app immediately.

2. Eligibility

To use Giver, you must:

• Be at least 18 years old or have guardian consent

• Have a valid Zambian mobile number

• Possess an active mobile money account (Airtel, MTN, or Zamtel)

• Be a registered member or participant of a church using Giver

By using Giver, you confirm that the information you provide is accurate and truthful.

3. Account Registration

To access certain features, you must create an account using your phone number and PIN.

You agree to:

• Keep your PIN confidential

• Use a secure device and avoid sharing your login credentials

• Notify Giver immediately if you suspect unauthorized access

You are responsible for all activities under your account.

4. Contributions & Payments

a. Contribution Types

Users can contribute to:

• Tithes

• Offerings

• Pledges

• Building Fund

• Missions

• Special Donations

b. Payment Processing

All payments are securely processed via Airtel Money, MTN MoMo, or Zamtel Kwacha.

Transaction success depends on your mobile money balance and network availability.

Once processed:

• Contributions are non-refundable, except in cases of proven error or duplication.

• Digital receipts are automatically generated for transparency.

c. Transaction Confirmation

You will receive an SMS or in-app confirmation for each successful contribution.

Your church also receives a record of your giving for accountability and recordkeeping.

5. Church Membership & Data Sharing

Each user is linked to a church through an invitation code or church administrator setup.

By joining a church within Giver, you consent to share limited data (e.g., name, contribution type, timestamps) with your church for recordkeeping, goal tracking, and announcements.

Church administrators cannot access your mobile money wallet or PIN.

6. Fees

Giver may charge service or processing fees, which will be transparently displayed before completing a transaction.

Mobile money operators may also deduct standard transaction fees as per their terms.

7. Use of the App

You agree to use Giver only for lawful purposes and in accordance with these Terms.

You must not:

• Attempt to hack, reverse-engineer, or disrupt the app

• Use Giver for fraud, money laundering, or illegal fundraising

• Impersonate another user or church

• Upload false or misleading data

Violation of these terms may result in account suspension or termination.

8. Security

Giver employs bank-level encryption, PIN protection, and secure integrations to safeguard your information.

However, you are responsible for:

• Keeping your device secure

• Avoiding use of public Wi-Fi for transactions

• Immediately reporting suspicious activities

Giver is not liable for loss due to compromised user credentials or third-party misuse.

9. Limitation of Liability

While we strive for uninterrupted service, Giver does not guarantee:

• Continuous app availability

• Error-free transactions

• Uninterrupted mobile money service

Giver is not responsible for:

• Failures in mobile network or payment provider systems

• Incorrect user input (e.g., wrong amount or wrong church)

• Unauthorized access resulting from user negligence

To the maximum extent permitted by law, Giver shall not be liable for indirect or consequential losses.

10. Termination of Use

You may delete your account at any time through the app or by contacting support.

We may suspend or terminate accounts that:

• Violate these Terms

• Engage in fraudulent or abusive activity

• Pose security or compliance risks

All outstanding transactions prior to termination remain valid and final.

11. Intellectual Property

All app content, design, trademarks, and technology are owned by Giver Technologies Zambia.

12. Updates & Modifications

We may update these the Terms or app features from time to time.

Updates will take effect upon posting in the app or on our website.

Continued use after changes means you accept the revised Terms.

13. Governing Law

These Terms are governed by the Intellectual Property Law and others governing laws of the Republic of Zambia.

Any disputes arising from or related to Giver shall be resolved under Zambian jurisdiction.
